This paper summarizes and analyzes Branzburg v. Hayes, a 1978 US Supreme Court case that considers journalists’ right to protect their news sources versus the government’s need to protect the safety of its citizens. All four separate opinions rendered by the justices in this case are considered and analyzed. It is argued that the Court was wrong to reject journalists’ claims that the First Amendment required the recognition of privilege for journalists. In doing so, the Court jeopardized the freedom of the press.
