This paper provides an overview and analysis of the 1978 U.S. Supreme Court case, Branzburg v. Hayes, which stands today as the leading case on journalists’ right to protect their news sources versus the government’s need to protect the safety its citizens. Following an analysis of the four separate opinions in the case, it is argued that the Branzburg court was wrong to reject the newsmen’s claims that the first amendment required the recognition of privilege for journalists.
