Affirmative Action in Higher Education.This term paper presents an overview and analysis of the history and current state of affirmative action in higher education within the context of the history of racial discrimination in the United States. Following a brief overview of the Supreme Court’s changing views on racial discrimination and race classification and towards the interpretation of a “color blind” Constitution in the 20th century, the paper examines the history and current status of affirmative action in higher education. The essay includes a close focus on some of the key Supreme Court rulings – notably Brown v. Board of Education, Bakke, Adarand, and Hopwood – which have shaped the character of affirmative action in higher education. The concluding section considers the recent move away from affirmative action by some universities and the future prospects for affirmative action in higher education.
